Amendment On The Regulation On The Attorneyship Law

"The Regulation on the Amendment of the By-Law on Union of Turkish Bar Associations Attorney’s Law" has been published in the Official Gazette dated 02.09.2020. The amendment has brought the By-Law parallel with the Attorney’s Law which was recently discussed among stakeholders due to the establishment of multiple bar system. Within the scope of amendment;

» A new bar association can be formed with at least two thousand lawyers in the provinces where there are more than five thousand registered lawyers.

» The formation request shall be submitted to the Union of Turkish Bar Associations signed by two thousand lawyers and stating the names of persons involved in founders committee.

» The General Assembly shall convene for the election of bodies at the latest six months from submission, and will be notified to the Union of Turkish Bar Associations. Following the notification herein, the new bar will acquire the status of legal personality.

» After the new bar association acquires the legal personality, the registration of the lawyers who have a signature in the application will be deemed to have been revoked from the previous bar association.

» The new bar association will not be represented at the Union of Turkish Bar Associations of until the first Ordinary General Assembly Meeting convenes.

» The Union of Turkish Bar Associations shall notify in writing the new bar association to meet the minimum registered lawyer requirement, in the event the number of registered lawyers drops below two thousand. If such deficiency cannot be met within six months of the notification, the status of legal personality of the new bar association shall be ceased. In that case, lawyers and legal trainees registered with the bar association whose legal personality has ceased shall be registered to the other bar association in their province within fifteen days as of the announcement, or if there is more than one bar association, to the bar association they shall choose.
